TWO Oswestry men convicted of assault will have to wait to be sentenced after a court adjourned their case to be heard by the original judge.

Tommy Lewis of Blackbrook Drive and William Rowbotham, of High Lea Close, were set to be sentenced for their roles in an assault, with Lewis accused of grievous bodily harm (GBH) and the former with actual bodily harm.

They appeared in front of Judge Peter Barrie at Shrewsbury Crown Court on Thursday, July 21 but there was a call for an adjournment so the case could be heard in front of Judge Anthony Lowe.

Judge Lowe oversaw the original case with lawyers representing Rowbotham telling Judge Barrie that his colleague had intimated a guilty plea from their client would not result in an immediate custodial sentence.

However, it was acknowledged in the court that Judge Barrie was not bound by that ruling and could pass any sentence he saw fit, but he accepted the plea from the defendant and adjourned the case to a later unconfirmed date.

A third defendant, Rebekah Jones and also of Blackbrook Drive, was accused of GBH but Judge Barrie instructed a not guilty verdict to be recorded after the prosecution offered no evidence.
