An OSWESTRY-based land agent has been appointed to a new arbitration panel set up by the Central Association of Agricultural Valuers (CAAV) to help resolve rural disputes.

Philip Meade, of Davis Meade Property Consultants in Beatrice Street, joins a small and select number of land agents on the new panel who can be appointed by the president of the CAAV to resolve issues such as rent reviews and property disputes.

“Arbitrators in the past could only be appointed from a panel of selected surveyors appointed by the Royal Institution of Chartered Surveyors but the new Agriculture Act 2020 extended the choice to include the CAAV and Agricultural Law Association,” explained Philip.

The CAAV President can now appoint an arbitrator on the request of either the landlord or the tenant of a farm in a dispute under tenancies protected by the Agricultural Holdings Act 1986 or the Agricultural Tenancies Act 1995.

Disputes under those Acts typically include rent reviews, repairing issues, some notice to quit issues and end of tenancy claims.

The arbitrator’s job is to make a fair and impartial judgement after listening to and testing evidence and arguments put forward by the parties, acting a like a judge.

In rural cases, this may often be with a face to face hearing but can also be done with exchanges of written representations between the parties.

“I am delighted to be appointed to this new CAAV panel which will extend the choice for landlords and tenants and hopefully help speed up the dispute resolution process in a cost effective manner,” Philip said.
